Terms and Conditions for Waste Removal Ilford Services

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.2 "Customer", "you" or "your" means any individual, business or organisation that requests or uses our services.

1.3 "Services" means waste collection, removal, clearance, loading, transportation, and related services provided by us.

1.4 "Waste" means the materials, items, rubbish or refuse that you request us to collect and remove.

1.5 "Booking" means a confirmed request for our services, made by you and accepted by us in accordance with these Terms and Conditions.

2. Scope of Services

2.1 We provide waste removal and collection services for households, landlords, letting agents, businesses and other organisations. Our services can include the collection of general household waste, garden waste, bulky items, office waste and certain types of commercial waste.

2.2 All services are subject to availability and to the type and quantity of waste to be collected. We reserve the right to refuse to provide services if, in our reasonable opinion, the waste is unsuitable, unsafe to handle, or outside the scope of our licences or operating capabilities.

2.3 We may provide estimates of load sizes, vehicle capacity and waste volumes based on information you provide. Final pricing and feasibility will be confirmed on site following assessment of the actual waste to be collected.

3. Booking Process

3.1 You can request a booking by contacting us using our published contact methods. You will be asked to provide details including your name, contact information, collection address, access details, type of property, type and approximate volume of waste, any special handling requirements and preferred dates and times for collection.

3.2 Any quotation provided prior to inspection is based on the information you supply. It is your responsibility to provide accurate and complete information. If the information you provide is incomplete or inaccurate, we reserve the right to adjust the quotation or decline the booking.

3.3 A booking is only confirmed when we have accepted your request, agreed a collection time window and, where required, received any initial payment or deposit. We may confirm acceptance verbally, by email or by other written confirmation.

3.4 We will use reasonable efforts to attend your premises within the agreed time window. However, all times are estimates only and may be subject to change due to traffic, vehicle breakdown, weather or other circumstances beyond our reasonable control.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe, reasonable and unobstructed access to the collection address and to the waste to be removed. This includes ensuring suitable parking for our vehicle and clear pathways to the waste.

4.2 You are responsible for obtaining any necessary permissions, permits or consents required for us to access the property, including permissions from landlords, neighbours, building management or local authorities where applicable.

4.3 If we are unable to gain access to your property or to the waste due to access restrictions, parking issues, incorrect addresses or your failure to be present at the agreed time (where required), we may charge a call-out fee to cover our reasonable costs.

4.4 You must remove or secure any items that you do not wish us to take away. Our team may remove items that are located with, or appear to form part of, the waste to be collected. We accept no responsibility for the removal of items that you intended to keep if they were not clearly separated from the waste.

5. Waste Types and Regulations

5.1 We operate in accordance with applicable UK waste management laws and regulations. All waste collected by us will be transported and disposed of, reused or recycled at authorised facilities, in a lawful and responsible manner.

5.2 You must not present for collection any hazardous, toxic or specialist controlled waste unless this has been expressly agreed with us in advance and we are licensed and equipped to handle such materials. Hazardous waste may include, but is not limited to, asbestos, chemicals, solvents, oils, clinical waste, gas bottles, pressurised containers, certain electrical items and materials containing persistent organic pollutants.

5.3 We reserve the right to refuse to handle any waste that we reasonably believe to be hazardous, illegal, contaminated, unsafe, infested, or otherwise unsuitable for our standard waste removal services.

5.4 You are responsible for any fines, penalties, costs or losses incurred by us arising from your failure to accurately describe the waste or your presentation of prohibited or misdescribed waste for collection.

6. Pricing and Payment Terms

6.1 Our charges are typically based on the volume, weight and nature of the waste, the time required to complete the work, access conditions, and any additional services such as dismantling, packing, or extra labour.

6.2 We will normally provide an indicative price or price range at the time of booking, based on the information you provide. The final price may be confirmed or adjusted on site after assessment of the actual waste and work required.

6.3 Unless otherwise agreed, payment is due in full on completion of the service, on the day of collection. We accept payment by the methods we publish from time to time, which may include cash, debit card, credit card or bank transfer.

6.4 For business customers or larger projects, we may require payment in advance, a deposit, stage payments, or payment within an agreed credit period, subject to prior arrangement and our approval.

6.5 All prices quoted are exclusive of any applicable taxes or charges that may be imposed by law, which will be added at the prevailing rate where relevant.

6.6 If you fail to make payment when due, we may charge interest on overdue sums at the statutory rate, together with any reasonable costs incurred in recovering the debt, including legal fees and collection charges.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by contacting us directly. We ask that you provide as much notice as possible so that we can adjust our schedule.

7.2 If you cancel a booking with at least 24 hours' notice before the agreed arrival window, no cancellation fee will usually be payable, unless we have incurred specific costs on your behalf, which we reserve the right to recover.

7.3 If you cancel with less than 24 hours' notice, or if we arrive on site and are unable to complete the service due to reasons within your control (including inability to gain access, incorrect information, or refusal of the adjusted price), we may charge a reasonable cancellation or call-out fee to cover our time and expenses.

7.4 We reserve the right to cancel or re-schedule your booking at any time due to vehicle breakdown, staff shortages, severe weather, safety concerns, or other events beyond our reasonable control. In such cases, we will use reasonable efforts to notify you and offer an alternative date and time. We will not be liable for any indirect losses or costs arising from such cancellations or delays.

8. Customer Conduct and Health and Safety

8.1 You agree to treat our staff with respect and to provide a safe working environment at the collection address. We reserve the right to withdraw our staff and terminate the service if they are subject to abuse, threats or unsafe conditions.

8.2 Our team will follow reasonable health and safety procedures while on your premises. You must inform us of any known risks, structural issues, dangerous access routes, or other hazards that may affect our ability to carry out the work safely.

8.3 We may refuse to carry or move items where doing so could cause damage to property, pose a risk of injury, or be contrary to safe working practices. We may also refuse to enter areas that are unsafe, excessively cluttered, or structurally unsound.

9. Liability and Limitations

9.1 We will perform our services with reasonable care and skill. If we fail to do so, you may be entitled to a repair, re-performance, or a partial refund, in accordance with your statutory rights.

9.2 Our liability for any loss or damage suffered by you arising out of or in connection with our services shall be limited to the amount you have paid or agreed to pay for the relevant service, except where such limitation is not permitted by law.

9.3 We are not liable for any indirect, consequential or economic losses, including loss of profit, loss of business, loss of opportunity, or loss of data, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise.

9.4 We accept no liability for any pre-existing damage to your property, fixtures, fittings, or contents, nor for damage resulting from inherent defects, wear and tear, poor construction, inadequate maintenance, or items not reasonably fit to be moved.

9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter in respect of which liability cannot be lawfully limited or excluded.

10. Ownership of Waste and Title

10.1 Once waste has been removed from your premises and loaded onto our vehicle, title to that waste transfers to us, subject to applicable laws and regulations.

10.2 We reserve the right to sort, separate, reuse, recycle, recover value from, or dispose of the waste in any lawful manner we deem appropriate.

10.3 Where you have misdescribed waste or presented prohibited or hazardous materials in breach of these Terms and Conditions, title to such materials may be deemed never to have passed to us, and you will remain responsible for them.

11. Data Protection and Privacy

11.1 We will collect and process your personal data only for the purposes of managing your booking, providing services, handling payments, and complying with legal obligations.

11.2 We will take reasonable steps to keep your personal information secure and to prevent unauthorised access or misuse. We will not sell your personal data to third parties.

11.3 We may share your information with trusted partners and service providers where necessary to perform our services, process payments, or meet legal requirements. Any such sharing will be limited to what is reasonably necessary.

12. Complaints and Dispute Resolution

12.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible, providing full details of your concern. We will investigate and respond within a reasonable time.

14.1 These Terms and Conditions, and any disputes or claims arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our services.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

15.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation as part of a business transfer or restructuring, provided that this does not materially affect your rights under these Terms and Conditions.

15.4 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us relating to the provision of our waste removal services and supersede any prior discussions, correspondence or understandings.
